Allegations
The allegations against Michael Vick are horrific, and if found to be true, Mike Vick should be put in jail and receive a lifetime ban from the National Football League. However, the great thing about the United States of America is that you are Innocent Until Proven Guilty. Michael Vick is innocent and has not been found to be guilty. As, Malcolm X so eloquently points out above, the media is powerful because the media has quickly made this innocent man guilty and attempted to deprive him of his due process. The Jim Rome Show, Colin Cowherd, ESPN, CBS, NBC, the NFL Network and everyone else should be ashamed for condemning this man before he is proven guilty. It is a fundamental tenant and American right. The media and court of public opinion are quick to convict you based on very little evidence. Granted in this case, a federal indictment was issued charging Michael Vick with several heinous crimes but (1) has he been found guilty of those crimes and (2) what as that evidence based on.
Indictment
More specifically, the 27-year-old Michael Vick, who is stated to have the nickname of "Ookie" in the indictment, ALLEGEDLY established the Bad Newz Kennels in Smithfield, Virginia in early-2001. It was this property, for which Vick paid $34,000, that the star athlete and his co-defendants used as the "main staging area for housing and training the pit bulls involved in the dog fighting venture and hosting dog fights." According to prosecutors, Vick and his co-defendants began purchasing pit bull puppies in late-2001 and would eventually select and "sponsor" individual dog fights with purses as high as $26,000. In the indictment's most heinous parts, federal investigators describe the allegations of what happened to some Bad Newz Kennels dogs that either did not fight, lost matches or did not perform well in test fights. For example after a March 2003 loss by a female pit bull, co-defendant Purnell Peace, "after consulting with Vick," wet the dog and then electrocuted the animal.
ALLEGED HEINOUS ACTS
In April of 2007, prosecutors allege, Vick, Peace, and fellow co-defendant Quanis Phillips, "executed approximately 8 dogs that did not perform well in various 'testing' sessions." These animals, the indictment claims, were killed "by various methods, including hanging, drowning, and slamming at least one dog's body to the ground.".
PROBLEM
Imagining a dog fight, makes my blood curl. The sound a dog makes when being killed by another dog is a sound that I never will hear so long as I can control it. Dog Fighting is wrong, it is heinous and it is a felony that deserves severe and expeditious punishment. However this severe and expeditious punishment must be reserved for those who are found guilty of participating in the felony. The co-defendants, former friends and people around this dog fighting ring have a tremendous incentive to point the finger at Michael Vick. Each will receive immunity of some sort for their testimony against Michael Vick and the enormous weight of the spotlight and stress will be wholeheartedly placed on Michael Vick's back. A burden that he must carry by himself while he attempts to prove his innocence. I only say prove his innocence because the media and the public has already found him guilty. Again, if Vick is found by a jury to be guilty he should suffer in every way possible, but we must wait until then or we jeopardize all of our liberties that make this country the best place to live in the world.
THE PRESUMPTION OF INNOCENCE
The Presumption of innocence is a legal RIGHT that the accused in all criminal trials has in most modern nations. It explicitly states that NO PERSON SHALL BE CONSIDERED GUILTY UNTIL FINALLY CONVICTED BY A COURT OF LAW. The burden of proof squarely rests on the prosecution, which has to convince the court beyond a reasonable doubt that the accused is guilty. In principle, the defense that the accused presents does not have to 'prove' anything during the trial. However, the defense may present some or all evidence tending to show that there is a reasonable doubt as to the guilt of the accused.
Conversely, in numerous authoritarian countries the prosecution case is, in their practice, believed by the court in default unless the accused individual can prove he is innocent, this practice is generally called presumption of guilt. Most people believe that presumption of guilt is inherently immoral and unfair because this presumption allows the strategic targeting of any specific individual, since it's generally difficult to solidly establish proof of innocence (for example, it is generally impossible to establish a believable alibi if the accused is home alone at the time of the crime.)
In many countries including the United States of America where the Anglo-Saxon legal tradition remains, the Principle of Presumption of Innocence is phrased to explicitly state that "the accused is presumed to be innocent until it has been declared guilty by a court". This abbreviated form of the presumption of innocence neglects the point that the accused may continue to appeal a court's decision, and that individual will be presumed innocent until a final decision is made in his case. Therefore people who have alleged to have committed a crime or been found guilty in lower courts of law, but have pending appeals, CANNOT have their liberties and citizen's rights (such as to vote and to be elected) stripped, or taken nor can these individuals be permanently removed from their elected offices, however they can be suspended.
THE FUNDAMENTAL RIGHT IN DIFFERENT COUNTRIES
The presumption of innocence is so important in most modern democracies that most countries have explicitly included the presumption in their legal codes and constitutions:
* In France, article 9 of the Declaration of the Rights of Man and of the Citizen, of constitutional value, explicitly states "Every man is supposed innocent until having been declared guilty." and the preliminary article of the code of criminal procedure explicitly states "any suspected or prosecuted person is presumed to be innocent until his guilt has been established". The jurors' oath reiterates this assertion.
* In Canada, section 11(d) of the Canadian Charter of Rights and Freedoms explicitly states: "Any person charged with an offence has the right to be presumed innocent until proven guilty according to law in a fair and public hearing by an independent and impartial tribunal".
* The Universal Declaration of Human Rights, article 11, explicitly states: Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
* Although the United States Constitution of the United States does not cite the presumption explicitly, the presumption of innocence is widely held to follow from the 5th, 6th and 14th amendments. See also Coffin v. United States.
* The Convention for the Protection of Human Rights and Fundamental Freedoms of the Council of Europe explicitly states (art. 6.2): "Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law". This convention has been adopted numerous times by treaty and is binding on all Council of European members. Currently (and in any foreseeable expansion of the EU) each and every country member of the European Union is also member to the preeminent Council of Europe, so this presumption stands for EU members as a matter of course.
IN SUMMARY
Dog Fighting is a cruel and heinous felony and those offenders found guilty should be prosecuted to the fullest extent of the law. However, as in every case, it is necessary that those alleged to have committed the crime are innocent until it is proven that they are guilty. This constitutional right is found in most nations and must adhere to this fundamental tenant or our very liberties and freedoms will be in jeopardy. The media will continue to condemn the accused but contrary to what Malcolm X said, we must not let the media control our minds, we must let the legal process prove the guilty and we most ensure that everyone is innocent until proven guilty.

With that said, the points made in the comment with the less than perfect grammar don't talk about this being a race issue, however they focus on America's concern and interest in the lives of animals over the lives of people. It is a very interesting point. As for your comment above, you missed the point and completely lost credibility for attacking the grammar and not focusing on the points. Though you might not think it sounds professional, as I don't either, the points are very well made, especially the closing.

Vick Is Guilty
Vick is clearly guilty and the legal system has sorted it out. I question why you say "go die painfully" to Vick as people make mistakes and so long as they recognize those mistakes and pay for those mistakes, they should be given another chance.
Dogfighting comparison
How is dogfighting illegal and the national fighting championship isnt? People beat each other to death,; they break bones, get concussions, and fight till they are knocked out. With respect to the UFC, the argument is that the people will be making the conscious choice to compete in UFC events, whereas the dogs, do not make the choice. They are born and bred to be fighters, however aren't many of our boxers born and bred to be fighters! At some point, they can choose, the argument is. Regarding your animals comment, I believe the argument would be that the slaughter of the animals is done "humanely", whatever that means? Vick Accepts Plea Deal
As most of you know, Michael Vick's lawyer made an announcement that Michael Vick will accept a plea agreement. The wheels have justice have worked and now we know that Michael Vick is at least guilty of what he has pleaded to. Now we must wait for the final resolution and then take swift and solid punishment against him.

As most people don't understand including you, this has nothing to do with Michael Vick, however has everything to do with our present media, legal system and court of public opinion. Not Correct
Most black people did not and do not believe that Michael Vick was innocent especially after his guilty plea. Spector should be innocent until proven guilty as well. We must let the legal system work its course as we should have in teh Vick case. Black people are more prone to think that race is a part of it because racism still exists in America and has existing for 300 years. Race may have nothing to do with the Michael Vick case, but unfortunately it can never be discounted. We are still unsure of the details of the plea and we should still wait to cast full judgment. We are not sure what he is admitting to or not. PRESUMED Innocent
For some reason, we seem to have forgotten this part... PRESUMED innocent... If someone is found guilty, they were NEVER innocent of the crime, they were PRESUMED innocent. It is IMPOSSIBLE to be found guilty and have been innocent until that verdict was reached, otherwise there would have been no trial... the person was innocent.
Now, as far ss this scumbag Vick is concerned, I don't believe most people PRESUMED him innocent either, because he would have had to be a drooling, shortbus riding MORON not to know what was going on literally in his own back yard. Here it is Friday, August 17, and I see that both of the guys involved in the dog fighting operation along with Michael Vick have today entered guilty pleas and have agreed to testify against Vick if he chooses not to enter a guilty plea. In fact, one of the two guys will testify at Vick's trial (if there is one) that Vick bankrolled the whole dog operation.
Vick will take the plea; his lawyers have strongly urged him to do so.
He was not innocent. He was never innocent. Your headline was wrong from the very day you posted it. And your whole analysis about the "presumption of innocence" is also wrong. The presumption of innocence refers specifically - and exclusively - to the burden of proof that rests with the prosecution, as a prior poster puts it. It doesn't mean jurors must consider a defendent to be innocent of what he/she is charged with.
In any event, Vick is guilty, and the evidence, contrary to what you write, is not hearsay.

Roger Goodell is the perfect example of someone who gets it! Under extreme pressure, as the commissioner of the NFL to suspend Vick prior to any court decision, he did not buckle. He has awaited for the legal process to sort itself out. He did not rush to judgment like everyone else. We are not saying that there is not an enormous amount of evidence against Vick, we are saying that nothing has been decided. Once a plea is entered and it is likely that one will be then we should make the determination. Employment Law
The NFL, as mentioned above, needs no federal conviction to suspend or fire an employee. It is not bound by the 14th amendment and requires no adherance to due process. The Atlanta Falcons, also a BUSINESS, fall under the same status and thereby need very little reason to suspend or fire an employee. Michael Vick is innocent until proven guilty; however, his status as an NFL employee is subject to termination or suspension regardless of a conviction. As far as racism goes, let's all just stick to the facts. Regardless of who has been oppressed for 300 years, that gives no one the right to commit a felony. Furthermore, the assumption that Michael Vick has been unfairly targeted because he's black is also immaterial..does that give him the right to not answer for potential crimes? Bringing race into the issue is insulting to all Americans, especially Black Americans. True equality requires all Americans to embrace the law instead of defending someone because he shares the same skin color. If you want equal protection under the law, then don't cry wolf when someone breaks it. The fact remains, no matter what happens to Vick in this case, that 60+ horribly treated dogs are now safe because of the humane society and the FBI...and I hope that people see this case as evidence to end this barbarous "sport".

As we can see, Goodell, the commissioner is not sure what to do either. He has not suspended Vick, just asked him to stay away from training camp. He knows that Vick's life is at stake and Vick may be fully acquitted, yet he has the league's future in his hand. It's tough. How can you explain Kobe Bryant being permitted to play during a rape trial? Don't you think that is worse, though both are heinous, a rape charge than dog fighting?
I agree with you regarding those that commmit a crime must be punished and this crime should be punished severely, but why can't we wait until the jury has decided or he pleads guilty, if that happens. What is wrong with taking the extra 6 months to make sure we are making the correct decision. We always want answers now, but those answers may not be right.
You can't just throw away 300 years of racism and oppression. My friends parents had to attend an all black high school because the district wasn't integrated yet. The Governor of the state specifically stated that no black students will integrate white schools. The Governor! And you don't think that racism still lingers? It's interesting to note Vick and three co-defendants plead not guilty to the charges brought against them. Is it possible all four are telling the truth and are innocent of all the charges? Although it is possible, it is highly improbable.
My bet is that at least one, if not more, are guilty of the charges and will be found guilty as charged. The innocent plea is more of a delay tactic to force a day in court. They are betting the evidence is lacking and reasonable doubt will prevail.
Our courts have this issue where lying can get you off scott-free. Just hire the right lawyers and pay enough money, one can get away with anything. I know it's best to have your day in court but if one pleads not guilty and is found guilty as charged, a heavy fine should be included to pay court costs and time lost. Sometimes telling the truth is the only way to go. Has the truth been told concerning the four defendants? If not, make them pay the price for lying.

The heavy price to pay for laying is the maximum sentence which can be imposed. 6 years is a long time behond bars. Why do you believe Vick is guilty? It's a conspiracy charge which is easier to prove, but it definitely is not a felony to attend a dog fighting match. Money determines many things in this world and that is a bad thing unless you have the money!

A person who sits in a car while someone robs a bank is just as guilty, a person in a crack house may not be smoking but just because they are there;they are quilty. You are right regarding the getaway driver for a bank robbery and applying it to the Vick case is accurate because many times the Feds use conspiracy to attach liability to that similar to Vick. Attendance at a dog fight in Virgina is a misdemeanor however we don't have solid evidence of that...yet.
